Criminal responsibility debated before bus murder trial in Winnipeg

The murder trial for Vincent Li, accused of decapitating 22-year-old Timothy McLean on a Greyhound bus in Manitoba last July, begins in Winnipeg this week and has reignited debate about whether people with mental illness should be treated or punished when they commit a crime.

If they want to be treated as a normal human being, they should be charged as such.

Someone mentioned to me the other day that he had been prescribed meds, but had gone off his meds, and then this happened.... is that correct?

Oh, and if it was the case that he had been diagnosed and treated, but decided to go off his medication not under a doctors supervision, and then this happened, I would hope for A LOT less leniency than if his mental illness had gone unnoticed and untreated.

If a person mentally ill or not, has the right to go into a store and buy a 10 inch blade (or whatever side knife he used), then he has the right to a trail that puts him behind bars for life.

Just for the record, its not like if you are declared not criminally responsible you are let out and all is forgiven. You can still end up in the forensic unit of a prison. Its more that it changes from being sentenced to punishment to being sent to treatment. You still just as confined and limited.

He could have made his point with the racist comments. I would have infracted him too if I saw the post. He knew he was on the edge of being banned since he already has a pile of infractions.

Agreed. I don't care how mentally un-fit you are... if you do something that like, you are fucked up and deserved to be locked up.

he didn't just kill a guy
he decapitated a guy .. on a crowded bus.. in the middle of nowhere

then ripped his body to pieces and held the head like a fucking trophy as if he was trying to show off his prize to already permanently scarred, innocent passengers.

'god told me to do it'.... go rot in jail you sick fuck...

Why can't we hold him responsible if he chose to stop taking meds? His lack of responsibility caused him to crack and kill one man, and alter the lives of several others.

    As devils advocate here:
He deserves to be locked up for his safety and more importantly the public's, however IF this is a mental health issue does he deserve to be punished, or treated?

As for holding him responsible the problem with mental health issues and meds is a difficult one.
For a normal person when we get a cough we take medicine. When the cough goes away, we stop. Now consider what would happen if for the rest of our life whenever we stopped taking the medicine the cough would come back. No biggie right, just keep taking the medicine. Well the difference here is that when the person takes their meds they feel better and act normal so they think problem solved and they stop taking them. Then when they start to revert back to their illness they do not realize that the medicine will help. On top of that many people say that the medicine makes them feel like a stranger is in their body and therefore don't want to take it.

See the illness attacks from so many different angles, that it has all its bases covered.

I would say a bit of both.

I dont think I'd go as far as saying he isnt criminally responsible, he did commit a crime and should be held accountable. But I get what you're saying.

You tell your severely 25 yr old mentally handicapped child not to play with guns or knives. One day he gets extremely angry that his 6 year old brother won't let him watch cartoons, goes upstairs, gets a knife from the kitchen and stabs him, and then goes back to watching cartoons like nothing happened.

    Criminally responsible?

I understand its not cut and dry. There is a lot of grey areas.

Again in this instance, yes, criminally responsible. What sort of punishment? I cant say.

Criminally responsible or not, it doesnt make much difference, as long as our society, and justice system puts him in a place where he cant hurt another person.

They should have gave him what he wanted and ended his life while he was ripping this innocent guy into pieces.

Well lets see, the RCMP shock a guy, who is no harm to four officers in an airport to the point where he is dead, yet they cannot shoot a man on an empty bus cutting an innocent guy into pieces? Something is totally wrong.
